Pension and Provident Funds
Pension funds can be set up either by individuals who seek to plan for
future retirement income or by corporations for the benefit of international
staff who may regularly move from one country to another in the course
of their employment. The pension funds are usually established as offshore
trusts in jurisdictions, such as Belize, where there is no taxation of
any sort on the income and capital gains of the funds, and no exchange
control restrictions. Considerable advantages may be obtained from having
such special corporate pension funds rather than having to create separate
funds, subject to local rules and regulations, for each country where
the corporation has its operations. Great flexibility can be included
in the trust to meet the specific needs of both the employer and the individual
employees.
Similarly, provident funds may be established to provide for savings
by individual employees, who will be able to withdraw the funds on retirement,
on leaving the company, or possibly on returning to their home country.
BOSL can act as Trustee for a pension fund or as manager of a
provident fund. As part of our duties, we will also arrange the necessary
investment management. The administration services include collecting
and recording all contributions, accounting to each participant for their
contributions, providing regular statements and reports both to the employees
and the corporation and handling all payments from the fund as required.
Unit Trusts and Mutual Funds

and can provide comprehensive services as Trustee and Custodian for unit
trusts and mutual funds. The use of units trusts/mutual funds as an investment
alternative is ever increasing and the managers of these funds require
reputable third party Trustees/Custodians to hold the underlying assets,
receive subscriptions, and pay out against redemptions.
Bond or Debenture Trusts
Corporations are often faced with the need to establish a trust relationship
to handle their borrowing programmes. Corporations raising capital from
non-domestic bond issues, debenture issues supported by foreign assets,
or loan stock to foreign investors, will require corporate Trustees in
an offshore jurisdiction to meet the needs of all parties. As Trustee,
BOSL can help to balance the different constraints, regulations
and taxation considerations that will exist in any multinational enterprise
or business relationship.
Escrow Arrangements
Escrows are normally used to hold the underlying assets being bought
by a buyer in one country from a seller in another. The payment terms
are often over a lengthy period of time and can be complicated by possible
currency risk, taxation implications, or exchange controls that might
apply to one or both of the parties. To enable the sale terms to be structured
efficiently to meet the needs of both parties, a reputable Trustee in
a neutral tax-free jurisdiction is most often advisable. BOSL can
provide the necessary trust framework and ongoing administration services.
Employee Stock Option Plans
With the increasing use of performance-related rewards for top personnel,
corporations need to find efficient means of handling arrangements for
a multinational workforce. What may be efficient in one jurisdiction may
not be in another. To combat the many variations that might be required,
BOSL can establish an offshore trust to hold the options and stock
that would be available to qualifying personnel. The trust conditions
